Why Don’t I Charge for Pearly Arts Images?

I don’t want to charge for our art because, as a graphic designer, I know how important and time-consuming our website or our commonsense it can be to just find a simple image to spruce up a brochure or website without running afoul of copyright laws.  I love drawing and I think I can make enough money off of advertising to justify this business venture.  So, while I do request and encourage that you grant Pearly Arts attribution if you use our images, we will not require it or punish you if you don’t.

How Do I Attribute an Image to Pearly Arts?

While we do request attribution, we will not require it.  If you are kind enough to include attribution, we do suggest the following format: “Name of Image” by Pearly Arts (with a link to the Pearly Arts home page).  Thank you.

All images published on Pearly Arts.com are royalty free. Pearly Arts grants to you (the user) a non-exclusive, worldwide copyright license to download, copy, distribute, perform, and use the images provided from Pearly Arts for free subject to the Terms and Conditions for using our site and the following limitations:

Personal, Educational and Editorial Use:

Our license allows you to use Pearly Arts images for individual, educational, and editorial uses.  Just don’t run afoul of our Terms and Conditions for using our website or our common-sense prohibited uses below.

Commercial Use:

You may use Pearly Arts images for most commercial purposes without permission from or attributing the creator or Pearly Arts. You may use Pearly Arts images for print and digital advertising, broadcasts, presentations, websites, menus, social media, and blogs. Limitation on commercial usage:  You may NOT use Pearly Arts images in the following manner:

• for product packaging, product designs, or other similar commercial uses without the express written permission of Pearly Arts.
• to compile assets, images from Pearly Arts to replicate a similar or competing service, in any form or distribute the assets in packs or otherwise. This extends to automated and non-automated ways to link, embed, scrape, search or download the assets included on the website.
• to merchandise Pearly Arts images for sale without the express written permission of Pearly Arts.
• in violation of the Prohibited Uses below or in violation of the Terms and Conditions for using our website.

Prohibited Uses:

• You may not sell or sublicense our images or copies of our images in any format.  
• You may not add our images to any image gallery or stock image site.  
• You may not claim that our images are your own work.
• You may not use our images in a manner that defames any person, is obscene, blasphemous, offensive, hateful, inflammatory, promotes or uses violence, or is sexually explicit.
• You may not use our images in a manner that promotes discrimination in any manner, including, but not limited to discrimination based upon race, nationality, religion, sex, sexual orientation, age, or disability.
• You may not use our images to promote illegal activity.

Duration of usage:

You agree that we may terminate this license agreement at any time. (We will not use “gotcha” tactics though like others.  If we terminate this license, you will not be liable for payment or charge unless and until you are notified to cease using an image.  There will be no charge for usage prior to you being notified.  We promise to give at least 60 days notice of our intention to charge.)  We do not plan to charge, but we do need to keep our options open. Right to edit.  You shall have NO right to edit a Pearly Arts image except as follows: You may re-size images, change color schemes, and add text near or around an image as long as you do not claim such image as your own. Purpose of license: We intend to generate revenue through advertising on our website.  Accordingly, we do request attribution (although we won’t require it).
